1) Harry was under the age of seventeen and still had the trace on him. Lupin and Tonks, both over the age of seventeen, did not. Also, the spell he had done was a very power spell.
2) Harry was not able to understand at the time he saw his mother killed. 'At the time' is the key phrase. In the case of Cedric, I'd assume that he was in shock (just as any normal person would be). Cedric's death - and everything that went along with it- hadn't quite hit him yet.
3) The spells Hermione had done were small and she was extremely young. Also, it never said she didn't get a warning.
4) Sirius is the only living, direct, full-blooded Black alive.
5) It said in book 6 that Montegue was in some weird limbo place between Hogwarts and Borgin and Burkes. As for getting back, well, that's how he wound up in a toilet and spliched, innit?

I think the main point with the Threstrel debate is that, in my understanding, Harry did not see his mother die. He only saw green light. I've always understood that he was blinded or something by it.

^^ I agree, but I also think it might be because he was an infant, and therefore unable to understand death, or remember it.

hmmm
About the prefect thing. What Ron and Hermione say is that prefects can't dock points from other prefects.

1. Harry was still an underage wizard, the Ministry still had the trace on him. Lupin and Tonks are both full grown adults who are not being traced by the ministry, and are perfectly entitled to use magic.

2. As for the thestrals thing, I think the reason Harry couldn't see them untill after whitnessing Cedric's death was because he was just an infant when he saw his parents die. He was to youn to understand death, nor remember it. The reason he couldn't see them at the end of GoF was because the shock of Cedric' death hadn't sunk in yet. Only after he went back to the Dursleys and spent two Months having nightmares about it, and dwelling on it did he begin to realize what he had whitnessed.

3. It never actually said where she tried these spells. It could have been on the train right before she talked to them. Also, she describes them as "simple spells." I don't think those count.

4. Ron was talking about docking points from Malfoy, who was also a prefect. Prefects can dock points from students, but not other prefects.

5. True, but that dosen't mean you can't use other wands, they just won't work as well.

6. Sirius was the last living male Black, he was forced to obey him.

Harry didn't actually SEE his mother die. If this person took the time to go to Jo Rowling's website and read the FAQ, you can clearly read that Harry was in his crib at the time. All he saw was "green light"
