What is this bird called? (i'll give anda a prop even though u guess)

Okay. THis is a bird, but I"m not sure what is it called. It's really an interesting bird when I took the picture. It can scare people (without people getting hurt), whenever people were below their nest in the tree. Thanks. XD

It is abundant across North America and can be found near any body of water. It builds nests near the ground. Its about 8.5 inches, has a stocky body, long tail and rounded wings. oh, i forgot to tell that i saw the sign, it's called red something, but i can't remember, so it's not a crow... but thx anyways. lol. everytime i look at the bird it makes me laugh.

hahaha, it's not a gagak for sure, hehe, it attacks people sejak flying above people's head and make a scary sound, but doesn't hurt anyone. lol.
