Welcome to the official website www.BoondocksBack.com (the “Site”) of The Boondock Saints: Origins TV Series provided by DCTV Pre Order Productions Inc., 30 Booth Avenue, Suite 204, Toronto, ON, M4M 2M2 (“DCTV”, “we”, “our”, “us”, etc.). These Terms and Conditions, including Supplement A (“Terms”) govern your access and use of the Site, the campaign to raise contributions to fund the production of The Boondock Saints: Origins TV Series (the “Campaign”) and any rewards for your contributions to the Campaign (“Reward(s)”).

YOUR USE OF THE SITE CONSTITUTES YOUR AGREEMENT TO FOLLOW AND BE BOUND BY THESE TERMS (THE “AGREEMENT”).

PLEASE SEE SUPPLEMENT “A” AT THE BOTTOM OF THESE TERMS FOR IMPORTANT INFORMATION ON THE BOONDOCK SAINTS: ORIGINS TV SERIES REFERRAL AFFILIATE PROGRAM.

Your use of the Site from any location is subject to your compliance with all applicable laws and regulations that may be applicable to you. You agree, and confirm, that your use of the Site is in full compliance with the laws of the jurisdiction(s) that apply to you, and that you are not prohibited from using the Site due to any restriction, including any age restriction.

While we encourage you to read this entire Agreement, some of the key Terms we want to bring to your attention are:

No Guarantees. We are working hard to bring The Boondock Saints: Origins TV Series to you, but we need your help. Our Campaign effort is “all or nothing”. Contributors to the Campaign are eligible for this limited-time offer of special Rewards. If we do not receive enough contributions to meet our bottom line, the production of The Boondock Saints: Origins TV Series will not move forward. Subject to these Terms, we make no guarantees to the creation, development or otherwise of The Boondock Saints: Origins TV Series.

Delay in Payment Processing. If we do not receive enough contributions to meet our minimum Campaign goal, then we will not proceed with your payment method, you will not be charged and you will not receive the selected Reward. If we meet our minimum target, we will charge your method of payment. This charge will likely be near the end of this limited-time offer ending June 26th, 2017. Please make sure your method of payment is ready to be processed during this period from today’s date and for the next 90 days.

Reward Details. Our Campaign has a lot of great Rewards in recognition for your contributions, including: The Boondock Saints: Origins Collector’s Box Set, a 10-month subscription of The Boondock Saints: Origins merchandise, The Golden Ticket and The Ultimate VIP Experience Packages. The details for each Reward can be found in each Reward details page on the Site. You will receive an email from us with the Reward details, contribution confirmation and a copy of these Terms.

Bonuses / Benefits. When you make a contribution, you may be eligible for extra bonuses and benefits in the future, including an opportunity to enter a contest. We may email you at the address you provided when you made your purchase to let you know about these promotions. You can unsubscribe at any time from these emails by clicking “unsubscribe”. However, we may still email you to keep you updated on your Rewards or other important information or news about the Campaign or The Boondock Saints: Origins TV Series.

Affiliate Referral Program. See Supplement A at the bottom of these Terms.

DCTV reserves the right to modify these Terms at any time, at its sole discretion. If DCTV decides to change these Terms, we will post those changes here. We encourage you to visit this section of the Site regularly in order to remain informed of any changes.

Your continued access to and use of this Site will constitute acceptance of the amended Terms. If you do not agree with these Terms, or any future amendments, your sole recourse is to cease use of the Site.

All contribution levels on our Site quoted are payable in United States Dollars. We reserve the right to correct any errors in the contribution levels associated with particular Rewards.

To make a contribution you will require a valid debit card, credit card and ACDH debit. We use 3D Secure for all payment processing. The cardholder and the purchaser must be one and the same person. When you make a contribution, you authorize us (or our service providers) to bill the payment method you provided for your contribution plus any applicable taxes or fees, including shipping, handling and other applicable delivery fees.

We use Secure Sockets Layer (“SSL”) technology to protect the security of your credit card information as it is transmitted. SSL is the industry standard for secure commerce transactions. Your personal information is encrypted, including credit card number, name and address. Nevertheless, there are certain risks associated with using the internet and you should be aware that 100% security is not always possible.

You are required to provide your method of payment and confirm your contribution but your payment method may not be charged immediately. We will charge you if and once we reach our Campaign target. If we do reach our minimum target, you should expect your payment to be collected by June 26th, 2017 (“Campaign End Date”).

If we are unable to charge your billing method for any reason, such as an expired credit card or insufficient funds, we may continue trying to bill your payment method. Please make sure your payment method provided is up to date and valid for processing.

Our Rewards include terms and conditions relating to the specific Reward not mentioned in these Terms (“Reward Details”). If you accept a Reward, you agree to the Reward Details and these Terms that collectively constitute your agreement with us. Both the Reward Details and a link to these Terms will be provided to you by email in an order confirmation after you finalize your contribution (the “Contribution Confirmation”). All contributions are non-refundable. You cannot change or cancel your contribution once you have authorized payment even if we have not yet processed your payment.

The estimated delivery date will be displayed during the purchase process (the “Estimated Reward Date”) as well as in your Order Confirmation. The Estimated Reward Date is our estimate based on several factors and subject to change. The Campaign End Date is our estimate of when this limited time campaign will end and determination of whether the project will continue, including whether your Rewards will be delivered — not a guarantee to fulfill by that date. We reserve the right to change our schedule as our project proceeds. We will make every effort to communicate our updates, including if and when delivery of your Product is expected.

If you have requested the Collectors’ Box Pre-Order, some of the monthly merchandise deliveries may be combined and delivered in the same shipment. We reserve the right to combine more than one of the 10 monthly merchandises into the same delivery of the Collectors’ Box Pre-Order during the course of the 10 months.

While we ship Rewards to many countries; we cannot guarantee we can ship to all countries. We will notify you if we cannot deliver your selected Reward to your country.

Shipping and handling costs will be disclosed at the time of checkout. Shipping and handling for certain Rewards may be up to $100.00 USD for the United States and Canada. Shipping and handling for certain rewards may be up to $200.00 for international destinations. You are responsible for any and all shipping and handling costs. Depending on your location, your order may be subject to international taxes, tariffs and value-added tax (VAT). International orders may be subject to customs clearance procedures that can cause delays in delivery that are out of our control. International orders may be subject to duties and taxes and require payment at the time of delivery. You agree you are responsible for any additional fees, tariffs and taxes applied.

DCTV relies on the information you provide through our Site, including purchaser information (name and email address), referral information, and method of payment information (credit card number and expiration date), delivery information (mailing address) and other transaction-related information (“Order Information”). Your Order Information must be true, accurate, current and complete. You are solely responsible and liable for any and all loss, damage, and additional costs that you, we or any other person may incur as a result of your submission of any incorrect, false, or incomplete information or your failure to maintain a valid method of payment within 90 days of any change.

You hereby consent to the exchange of information and documents between you and DCTV over the internet or by email and that these Terms (together with any applicable Order Confirmation(s)) in electronic form shall be the equivalent of an original written paper agreement between us. You further agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

You agree you will not use, copy, reproduce, modify, translate, publish, broadcast, transmit, distribute, perform, upload, display, license, sell or otherwise exploit for any purpose any Content not owned by you (i) without the prior written consent of DCTV and / or the applicable owner of that Content or (ii) in a way that violates someone else\'s (including DCTV) rights.

Your use of the Site does not transfer to you any ownership or other rights in the Site or Content. You may only use the Site and Content only in the manner described expressly in this Agreement and subject to all applicable laws. Affiliates of The Boondock Saints: Origins Referral Affiliate Program may have additional rights, see supplement at the end of these Terms.

Certain logs, names and other content on the Site and in connection with the Rewards may be registered or unregistered trademarks, service marks, tradenames and logos owned or licensed by DCTV or their respective owners or licensees (“Marks”). Any use of the Marks is strictly prohibited unless expressly provided in this Agreement or in writing. Nothing appearing on our Site, Products or elsewhere shall be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of the Marks.

Although we strive to update and keep accurate as much as possible the Content contained on the Sites, errors and/or omissions may occur.

THE LAWS OF CERTAIN JURISDICTIONS, INCLUDING QUEBEC, DO NOT ALLOW THE EXCLUSION OR LIMITATION OF WARRANTIES AND THE EXCLUSION OR LIMITATION OF REPRESENTATIONS MADE CONCERNING THE SITES. UNDER NO CIRCUMSTANCES WILL DCTV BE LIABLE FOR ANY LOSS, INJURY, CLAIM, LIABILITY OR DAMAGE OF ANY KIND RESULTING FROM YOUR USE OF, OR INABILITY TO USE, THE SITE OR THE REWARDS TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DCTV DISCLAIMS ALL RESPONSIBILITY FOR ANY LOSS, INJURY, CLAIM, LIABILITY OR DAMAGE OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES OF ANY KIND (INCLUDING, WITHOUT LIMITATION, LEGAL FEES AND EXPENSES) RESULTING FROM, ARISING OUT OF OR IN ANY WAY RELATED TO YOUR USE OF THE SITE OR THE REWARDS.

By using the Site you agree to defend, indemnify and hold harmless DCTV, its licensors, contractors, agents and partners and their respective employees, officers, directors, contractors, agents and partners from any and all claims, liabilities, costs and expenses, including, without limitation, reasonable legal fees and other legal expenses, whether in tort, contract or otherwise, relating to or arising out of your use of the Site, connection thereto, or any alleged violation by you of these Terms.

For individuals in a jurisdiction that requires a specific statement regarding waiver and release then the following applies.

For example, California residents must, as a condition of this Agreement, waive the applicability of California Civil Code Section 1542 for unknown claims which states: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR." Each individual hereby waives this section of the California Civil Code and any similar provision in law, regulation or code that has the same effect or intent as the foregoing release.

Subject to these Terms, DCTV and its service providers grant you access and a limited, non-exclusive, non-transferable license to access and make personal use of this Site, the Content and the Rewards. You are prohibited from using this site in any commercial way and you are prohibited from reselling the Rewards.

DCTV and our service providers collect, use and disclose personal information in order to provide the Site, Rewards and other services as discussed in these Terms. The only information we collect is the information you provide directly to us or one of our service providers, for example, to process payments, deliver Rewards, and develop promotions and to communicate to you. We employ security measures relevant to the sensitivity of the personal information. Information collected may be stored, transferred or accessed outside of the country in which you reside, including Canada and the United States, and therefore subject to the laws of other jurisdictions.

By accepting this Agreement, and each time you use the Site, you consent to the collection, use and disclosure of your personal information by DCTV and its service providers in accordance with these Terms.

These Terms do not apply beyond this Site. You agree that we are not responsible for the content on other websites and we encourage you to read the terms and conditions of any website you visit.

Unless otherwise required by law, these Terms are governed by and will be interpreted in accordance with the laws of the Province of Ontario and of the laws of Canada applicable therein, without regard to any principles of conflict of laws. You agree that any action to enforce these Terms may be brought in the courts located in the Province of Ontario. You further agree to submit to the personal jurisdiction of these courts for the purpose of any proceeding arising out of these Terms and waive any objections and defenses inconsistent with such venue. By using the Site, including making a purchase, you represent and warrant that your use complies with applicable law in your jurisdiction of residence.

English shall be the language of the Site including all transactions occurring in connection with our Site. All parties waive any right to use and rely upon any other language, or translations. Supplement A - The Boondock Saints: Origins TV Series Referral Affiliate Program

The Boondock Saints: Origins TV Series Referral Affiliate Program (“Program”) is provided by DCTV and supported by https://www.referralcandy.com/ and www.trycelery.com (“Celery”). In addition to the terms and conditions of the Agreement, Affiliates of the Program (“Affiliate(s)”) are also subject to the following Terms.

During the Campaign but before the Campaign End Date, Affiliates must register with the Program on the Site by following the onscreen instructions including providing name, email address and other requested information. Further, Affiliates must comply with Celery’s terms of service at all times, available at: https://www.trycelery.com/terms.

Affiliates can do their part to help The Boondock Saints: Origins TV Series meet its goals and become a reality by spreading the word and encouraging their friends and family to contribute to the Campaign.

Affiliates reach out to their friends and family in which they have an existing relationship with (“Lead(s)”). Affiliates may communicate in person, by telephone and / or by email and social media;

Affiliates inform Leads about the Campaign and encourage Leads to visit www.BoondocksBack.com;

Leads must contribute and select the 10-month subscription of The Boondock Saints: Origins merchandise;

Leads must include the referring Affiliate’s name and e-mail address when finalizing the transaction; and

Celery tracks all Eligible Referrals for each Affiliate during the Campaign (“Eligible Referral(s)”).

Affiliates are prohibited from communicating to non-Leads (e.g. strangers) by telephone, e-mail, social media and other electronic communications.

At the conclusion of the Campaign, each of the top three hundred (300) Affiliates with the most Eligible Referrals will be rewarded with a Silver Ticket, as described on the Site. In addition, each of the top three (3) Affiliates will also be rewarded with the opportunity to have a walk-on role in The Boondock Saints: Origins TV Series, including awarding a title and courtesy credit as an Associate Producer for the first season. Alternatively, a top three (3) Affiliate may gift his/her reward to a friend or family member (“Leader Rewards”).

All Leader Rewards are subject to these Terms and may be subject to additional conditions and restrictions.

As described in these Terms, Affiliates understand and acknowledge that that the Campaign is “all or nothing” and Rewards and Leader Rewards are not guaranteed.

In the event of a dispute between an Affiliate and DCTV regarding the Program, including but not limited to Eligible Referrals, Affiliate acknowledges and agrees decisions by DCTV shall be final.

The Program is offered solely to Affiliates for the purposes described in these Terms and not for commercial or competing use.

Affiliates acknowledge and agree that content they send and / or post will be publically attributable to them. DCTV may permit Affiliates to share portions of the Site and Content (as described in section 8) across websites, such as through the use of social media. In these instances, the use of our Site and Content is still subject to these Terms. For example, DCTV may provide Affiliates with Content or other marketing materials to assist in obtaining Eligible Referrals for the Program. We reserve the right to prevent sharing of our Site and Content, including for violations of our Terms.

Affiliates agree not to make any false or misleading representations, including but not limited to Leads, with respect to the Program, Campaign, Site and / or these Terms.

comply with all applicable laws, including anti-spam and privacy legislation that may apply in their jurisdiction;

comply with all terms and conditions used in relation to their participation in the Program, including but not limited to any website, software, social media platform terms and conditions; and

immediately honour every request to no longer receive communications regarding the Program and cease sending such communications.

In addition to the requirements set forth in other sections of these Terms, Affiliates agree not to access and/or use the Site or Program for any purpose not expressly authorized by these Terms and/or transmit, post, use or distribute content to Leads or anyone else that:

constitutes spam, chain letters, and pyramid schemes;

contains or constitutes software, computer programs, or routines of any kind, including but not limited to, viruses, bots, worms, spiders or offline readers;

copies or distributes any part of the Site in any medium without DCTV’s prior written authorization;

reverse engineers or decompiles the software comprising or included in the Site;

communicates to individuals or organizations other than Leads;

is illegal, abusive, defamatory, deceptive, fraudulent, invasive, racist or otherwise inappropriate or illegal; and / or
